Technology, media and entertainment businesses face a distinctive combination of regulatory, commercial and rights-related issues in Turkey. MARIF advises international and domestic businesses across the sector, including technology companies, digital platforms, broadcasters, streaming and on-demand services, content businesses and other participants in the media and entertainment market.

Our work reflects the way these businesses operate in practice. A new platform, service or content offering may involve broadcasting or internet regulation, consumer and subscription rules, advertising, content rights, data protection and commercial arrangements at the same time. We help clients address these issues together and adapt international business models, products and contractual structures to Turkish law.

We have particular experience in the Turkish media and digital regulatory environment. This includes advising on matters involving the Radio and Television Supreme Council (RTÜK) and the Information Technologies and Communication Authority (BTK), as well as the regulatory requirements applicable to broadcasting, streaming, on-demand media and online platforms. We also advise on consumer and advertising matters, data protection and cybersecurity issues that arise in connection with digital products and services.

Our disputes experience is an important part of our sector offering. We represent clients in commercial, regulatory, copyright and content-related disputes and administrative proceedings, while using that contentious experience to identify risks in contracts, regulatory strategies and business models before disputes arise.

  • Advising on Turkish regulatory requirements applicable to broadcasters, streaming and on-demand media services, digital platforms and online businesses, including licensing, authorisations, notifications and dealings with RTÜK and BTK.
  • Drafting and negotiating sector-specific agreements, including software and technology agreements, digital platform and service arrangements, broadcasting and channel distribution agreements, content licensing, production and co-production agreements, talent arrangements, sponsorships and other content-related contracts.
  • Advising on the acquisition, licensing, distribution and exploitation of audiovisual and other content, including copyright and related-rights matters, collecting societies, claim management and related disputes.
  • Advising on consumer-facing digital and media businesses, including subscription models, e-commerce, advertising, promotions, digital marketing and consumer regulatory requirements.
  • Advising on data protection, international data transfers, cybersecurity and data-governance issues arising from technology products, platforms, streaming services and other digital businesses.
  • Supporting M&A, investments, reorganisations and corporate structuring involving technology, media and entertainment businesses, including the sector-specific regulatory and ownership issues affecting those transactions.
  • Representing clients in commercial and regulatory disputes, copyright and content-related claims, administrative investigations and proceedings involving sector regulators and other Turkish authorities.
